Wavve Boating Inc. (“Wavve”) Important Terms [Scroll Down]
THESE TERMS AFFECT YOUR LEGAL RIGHTS. YOU SHOULD READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE WAVVE MOBILE APPLICATION (THE “SERVICE”).
You have read and agree to the full ‘Terms of Service’ https://wavveboating.com/terms-of-service and ‘Privacy Policy’ https://wavveboating.com/privacy-policy, which together govern all users’ activities, agreements, and conduct with respect to Wavve. Certain important terms are summarized below. However, to be clear, you are bound by the complete Terms of Service and Privacy Policy. If the summary below conflicts with the Terms of Service and Privacy Policy in any way, the complete Terms of Service and Privacy Policy will govern:
- If you choose to use the Service while operating your vehicle to assist with navigation, you must remain aware of your surroundings. The Service is not a substitute for maintaining an adequate watch and awareness of your surroundings while boating, nor does the Service replace legally posted information or navigational aids. In the event that legally posted information or navigational aids instruct differently than the Service, you must not rely on the Service.
- You agree and acknowledge that you assume full, exclusive, and sole responsibility for the use of and reliance on the Service, and your use of or reliance on the Service is made entirely at your own risk. It is your responsibility to comply with all applicable laws while using the Service. Wavve is not responsible for any cost you incur in connection with your use of the Service, including cost of an Internet and/or mobile connection and any associated charges.
- The Service is billed on a subscription basis, managed and controlled by either Apple through the Apple App Store or Google through the Google Play Store. Your subscription will automatically renew at the end of your billing cycle. If you choose to cancel your subscription, Wavve will not refund any portion of your subscription fees paid prior to cancellation.
- You agree to indemnify, defend and hold harmless Wavve, its principals, officers, directors, representatives, employees, contractors, licensors, licensees, suppliers and agents (the “Wavve Team”), from any and all claims, liabilities, damages, losses, obligations, costs, expenses (including legal fees), actions and demands arising out of or in connection to your use of the Service.
- The Wavve Team shall not be liable in contract, tort, equity, or otherwise for any loss or damage arising out of or in connection to your use of the Service.
- You agree not to sue Wavve in court. If any dispute arises out of your use of the Service, it will be mediated and/or arbitrated in Toronto, Ontario, under Ontario law.
- You can decide whether or not to upload content to the Services. However any content that you submit for public posting, may be viewed by all users of the Services and by Wavve.
- Your use of the Service shall be governed by the laws in the Province of Ontario and the laws of Canada, as applicable, without giving effect to any conflicts of law principles.
